Over countless centuries, we as a people have been threatened and attacked by various nation states and groups. These groups attack with the intention of oppressing and enslaving the people of this great land as if we were nothing. In order to form a unified collection of peoples under the same principles of equality, collaboration, and liberty, we the people do establish this constitution of the Republic of Mastona.
The foundation of the federal government of Mastona is the Cabinet. The Cabinet shall consist of three sections: the Office of the President, the Council of Ministers, and the Council of Provinces. This collective is responsible for proposing and revising the laws of the Republic of Mastona. The Office of the President is the collective name for the President and the Vice President of the Republic of Mastona.
The President of the Republic of Mastona, or simply the President, is the leader of the nation state. All laws are to be enacted and ultimately approved by the President. Every President must be accompanied in the Office of the President by a Vice President. The President has the ability to approve and enact a law or veto a law. Should the President veto a law, the other members of the Cabinet can vote by a majority of two-thirds to overrule the veto and enact the law without the signature of the President. The President is the commander-in-chief of the Mastonian military and has the ability to declare war on another nation state should the need arise.
A citizen of the Republic of Mastona can be elected to the Office of the President by a popular voite of their fellow citizens. The President serves for a single four-year term. Once the term is over, one cannot run for the Office of the President again. The President can also be impeached and removed from office early by a one-half-plus-one majority of the popular vote.
The Vice President of the Republic of Mastona, or simply the Vice President, is the elected successor to the Office of the President. Should the President be unable to perform the duties of the Office of the President by reason of death, physical inability, or mental inability, the Vice President becomes the President for the remainder of the current President's term. A Vice President who became President by matter of succession can run to become President should they so choose. Should the President regain the ability to perform the duties of the Office of the President during the remainder of their term, they shall return to the Office of the President and the Vice President will return to the Office of the Vice President.
As the holder of the Office of the Vice President, the Vice President serves as the President's main advisor in decision-making. The Council of Provinces has the right to choose the Vice President. After completing a two-year term as Vice President, one cannot enter the Office of the Vice President again.
The Council of Ministers is a group made of the leaders of each of Mastona's federal Ministries. These ministries manage all aspects of the nation state and enforce the laws introduced by the collective Cabinet. Each Ministry shall have one Minister that sits on the Council of Ministers. This Minister also presides over a board of nine members that lead the individual Ministry.
Ministers are selected solely by the President. Ministers do not have a set term limit, but Ministers can be impeached from office following a two-thirds majority voite of the people or a one-half-plus-one majority vote by the rest of the Cabinet. Ministry boards meet to draft laws to be presented to the Cabinet for revision and enactment. Ministries can enact policies without the permission of the Cabinet so long as the policy does not infringe on any law enacted by the Cabinet or any rights set out in this document. These Ministry policies can be overruled by a one-half-plus-one majority vote of the Cabinet.
By order of law, the Republic of Mastona shall have the following Ministries. Should the need arise, more Ministries can be created and Ministries can be disbanded, thus changing the number of Ministers on the Council of Ministers.
i. Ministry of Defense The Ministry of Defense is responsible for storing, maintaining, using, and protecting Mastona's military weapons and supplies. Through the Minister of Defense, the President is the commander-in-chief of the Mastonian military. The Ministry is also responsible for determining the organization of the Mastonian military.
ii. Ministry of the Treasury The Ministry of the Treasury is responsible for minting national currency and monitoring economic stability. In collaboration with the Cabinet, the Ministry also collects and manages federal taxes and tariffs, should they be in place.
iii. Ministry of Agriculture The Ministry of Agriculture regulates farming, local and commercial, within the nation state. The Ministry is also responsible for land and animal conservation and environmental health, as well as any policies on agricultural equipment and chemicals.
iv. Ministry of Health The Ministry of Health is responsible for maintaining the quality of public health. The Ministry also regulates medicinal pricing, controls national health insurance, and monitors for potential public health crises in coordination with international entities.
v. Ministry of Justice The Ministry of Justice is responsible for enforcing federal law, setting standards for law enforcement, creating and regulating courts, and maintaining correctional facilities. It also implements fair punishments and fines for crimes committed that follow the guidelines set out in this document.
vi. Ministry of Internal Affairs The Ministry of Internal Affairs is responsible for maintaining Mastona's natural resources and allocating land usage for residential, commercial, and industrial purposes. The Ministry coordinates with the Ministry of Agriculture on conservational efforts and ground quality.
vii. Ministry of Foreign Affairs The Ministry of Foreign Affairs is responsible for maintaining relations with foreign nations and promoting Mastona national identity and sovereignty on the world stage. The Ministry also manages international embassies and communication with international entities, including the United Nations.
The Council of Provinces is a group comprised of leaders from each of Mastona's administrative provinces. These Provincial leaders, hereon referred to as Governors, are elected by the citizens of each Province by majority popular vote for a six-year term. After one has completed a term as Governor, they cannot run again for Governor in that Province.
Each Governor represents the voice of the people of their Province and should only act as such when conducting the duties of the Office of the Provincial Governor. The citizens of the Province should have constant, uninterruptable, and transparent communication with the Office of the Provincial Governor to voice their concerns and opinions. A Governor, in good faith, shall not go against the majority opinion of their Province.
A Governor can be impeached by majority popular vote of the citizens of the Governor's Province. After impeachment, the individual cannot be elected to any Governor position, no matter the Province.
The land inside the borders of the Republic of Mastona, as it stands at the ratification of this document, shall be divided into administrative Provinces, each with one provincial Governor to oversee provincial operations. These Governors serve on the Council of Provinces as representatives of the people of Mastona in the Cabinet. Local policy, infrastructure, tax, and power are managed by the provincial Government, however it may be established by each Province's constitutions. All policy enacted by a Province does not require permission from the Cabinet, but these policies may be vetoed by a majority vote from the Cabinet should a provincial policy go against federal law.
Any powers or aspects of government not explictly defined in this document or its additions as belonging to the Cabinet are given to the Provinces and their provincial governments.
Should it be deemed necessary, the Cabinet may propose Amendments to this Constitution that follow the spirit and rules set out in this document. No Amendment to this Constitution, nor any other law or policy enacted by any governmental entity in the Republic of Mastona, shall infringe on the rights of the citizens of the Republic of Mastona.
Should the Cabinet or any other form of governmental structure within the Republic of Mastona no longer be acting in the interest of the citizens of the Republic of Mastona, the citizens hold the inalienable right to abolish or overthrow the current government and replace it with one that appropriately serves the people and nation of Mastona.
In all official correspondence and communication with fellow nation states and other entities, this nation state shall officially be referred to as the "Republic of Mastona." For brevity, the names "Mastona" or "Mastonia" are accepted. The term "Mastonian" is preferred when describing objects related to the Republic of Mastona. The only officially-recognized languages in the Republic of Mastona are Mèstani and English, and working proficiency or fluency in one of these languages is required for Mastonian citizenship. Provinces shall maintain the right to designate more official languages within their provincial borders in addition to national languages. Both national languages are to be taught to all schoolchildren of Mastona.
All citizens of Mastona are automatically granted the following inalienable rights and freedoms. These rights and freedoms cannot be stripped from a citizen of the Republic of Mastona for any reason, including from being restricted by law or policy from any government entity.
i. Freedom of Speech All citizen has the right to say whatever they wish towards the Cabinet or other governmental entities or individuals without prosecution. Citizens are granted the right to petition the government with any grievances or opinions on the course of government. Free exercise of the press cannot be prohibited.
ii. Freedom of Religion Citizens of the Republic of Mastona are free to establish and practice any religion. The Cabinet is prohibited from restricting the establishment or practice of any religion, and religious beliefs have no place in government.
iii. Right to a Fair Trial Any person criminally prosecuted shall not be restricted from a fair trial of an impartial jury of their peers. A convicted citizen shall have the right to representative counsel, which shall be provided by the Republic of Mastona should it be required. The verdict of a trial can be appealed to a higher court should the prosecuted so choose, until the judicial Court of the Republic of Mastona should be reached and provide a verdict of common law. Any punishment inflicted upon the prosecuted shall not be unreasonable and shall be based on previous decisions and verdicts.
iv. Right to Privacy The citizens of Mastona shall maintain the right to be secure and allowed privacy with their person, home, a possessions. All citizens are to be protected from unreasonable searches or seizures by government authorities without a proper warrant obtained based on probable cause under oath. No citizen, unless probable cause and a warrant with the proper specification, shall be listened to, watched, or otherwise spied on by government authority.
v. Additional Rights Any rights and freedoms not listed in this document or taken by the Provinces are automatically given to the people of Mastona. The Cabinet may give the citizens more rights than are described in this document, but these rights and freedoms and additional rights and freedoms cannot be revoked after they are implemented.
An individual can gain citizenship to the Republic of Mastona by either having been born a current citizen in the nation state, or by meeting the following criteria: be fluent in a nationally-recognized language, live within Mastona for at least five years, and complete and pass a free standardized citizenship test over Mastonian history, culture, and government structure.
The national flag of the Republic of Mastona is defined as such: a field of blue on a banner with a width-length ratio of 3:5, upon which a teal or light blue saltire sits, with a white circle overtop at the very center with a diameter one half the size of the width of the banner. The national flag can be flown horizontally or hang vertically. When flying horizontally, the flag is to be lowered partially down the flag pole or mast for one day at the discretion of the President, such as during times of hardship or to commemorate federally-designated holidays.
This Constitution, with the approval of all citizens of the Republic of Mastona and the signatures from all members of the preliminary Mastonian Rètlune, on the fourth day of the month of December in the year one thousand nine hundred and thirty-nine, shall be ratified and agreed upon as law throughout the land, thus establishing the sovereign state of the Republic of Mastona.
